Terms and Conditions

1. Introduction

We are the Mysterious Package Company (MPC). Please take a moment to review these Terms and Conditions (the "Terms"). These Terms govern your participation in the promotional ‘Treasure Hunt’ (the ‘Hunt’) competition hosted on our current Kickstarter campaign for the forthcoming game No Escape: Dead Man’s Tale (DMT). This includes the use of the treasure map, clues, hints, and any other related materials provided to you by MPC or its affiliates. 

These Terms constitute a legal agreement between you and MPC, herein referred to as "MPC," "we," or "us." By participating in the Hunt you signify your agreement to these Terms. If you do not accept these Terms, you should forgo participation.

 MPC retains the right to modify these Terms at any time. If any changes are made, we will endeavor to notify you via email and post the updated Terms on our Website. We may also choose to cancel, suspend, or modify the hunt, either in part or in full, or your participation therein. Such actions will be executed at the sole discretion of MPC and will be in accordance with these Terms. Please ensure that you review any modified Terms before continuing your participation in the hunt. Your ongoing involvement implies your acceptance of the modified Terms. 

2. Eligibility

 The Hunt is open to legal consenting adults, specifically those who are 18 years of age or older. To gain access to portions of the puzzle information, participants are required to have pledged to the DMT kickstarter campaign. Participants will use the name associated with the registered pledge to submit their answers. If you fail to comply with these Terms, MPC reserves the right to take appropriate action. Current or past members of MPC or any of its affiliates or subsidiaries are ineligible to participate.

 This contest is void where prohibited by law. It is the responsibility of each entrant to ensure that their participation is legal in their respective jurisdiction.

 

3. The Treasure and Winning of the Treasure 

For the DMT Hunt, MPC will provide a set of puzzles leading to a corresponding set of correct answers. The winner of the competition will be drawn from a list of all correct entries. All answers must be submitted via the electronic portal at https://mysteriouspackage.com/puzzle4

• Any answer not submitted through this portal will not be counted. Players have 3 days from the date of publishing to submit an answer to any given puzzle. Answers submitted after that time will not be counted. The answer portal will be closed at 3pm EST on Saturday the 23rd of August 2024.

• Players must submit their answers in conjunction with the name that matches their campaign pledge. Answers submitted with names that do not match a registered pledge name will not be counted.

• One correct answer per puzzle, per registered pledge name will be counted. All additional submissions will be null and void.

• The competition winner, herein referred to as the "Finder," will be a participant in the promotion who has submitted at least one correct answer to a puzzle in accordance with the rules as stated. The prize awarded to the Finder shall be a gold coin with an estimated retail value of $3,677 CAD (the "Treasure").

• The winner will be drawn at random from a list of all eligible entrants. Eligible participants will be awarded one additional entry for every puzzle they correctly solve and enter into the electronic portal, for a maximum of 7 entries per person.

• It is important to note that the value of gold and silver can fluctuate daily, and MPC is not responsible for any such fluctuations. The Treasure is also subject to change to a prize of equal value without notice to the Participants and at MPCs’ sole discretion.

• Once the prize draw has concluded and the prize allocated to a winner, they are declared the Finder. MPC will put out a statement and send an email notifying all participants that the Treasure has been found and the Hunt is officially over. MPC will contact the winner shortly after to arrange the Treasure's delivery. It is imperative for the participant to provide accurate contact information and sign off accepting the Treasure. For further clarity, MPC is not responsible if the Treasure does not reach the winner or is unsuccessfully claimed within 30 days after the Hunt has ended.

In the event that a selected winner is disqualified or fails to claim the prize within the specified time, The Mysterious Package Company reserves the right to select an alternate winner from the remaining eligible entries. This process may be repeated until the prize is awarded.

4. General Disclaimers

 The DMT promotional treasure hunt is designed for at-home participation. It is not necessary to physically travel to any of the locations that may be featured or arise during puzzle solving or research by the participants. Any breach or trespass on unsanctioned public and private property rests on the participant and MPC is indemnified and the participant holds them harmless for any loss, damage, injury or otherwise. 

Winners are responsible for any local, provincial, and federal income taxes with respect to the Treasure. You agree to provide any required documentation to prove your eligibility for any awarded prize, including documentation regarding your tax identification number and status. You also indemnify MPC for any taxes, gains, and obligations to disclose.

 

5. Participation in the Hunt - Safe and Appropriate Behavior

MPC Reserves the right to disqualify any and all participants from the competition at its discretion. Grounds for disqualification include, but are not limited too:

 

• Harassment or badgering of other competition participants, backers, commenters or community members as defined by MPC.

• Threatening, intimidating, or antisocial commentary or behavior in any of our forums including social media platforms, disord, and Kickstarter campaign pages (KS)

 

You understand and accept the risks associated with your communications and interactions with other participants and any other individuals you communicate or interact with as a result of your participation in a Hunt. MPC does not screen or investigate the background of Hunt participants and does not provide representations or warranties concerning their behavior. You agree to exercise reasonable caution during your interactions with others.

 Any disputes with third parties related to your participation in a Hunt should not involve MPC. By participating in a Hunt, you release MPC, along with its officers, directors, agents, subsidiaries, joint ventures, and employees, from any claims and damages resulting from such disputes.

 

6 Recordings and Use of Likeness 

You consent to these terms and conditions approves and grants MPC the right to record your image, likeness, name, dialogue, biographic information, personal characteristics, and voice while participating in a Hunt and free use of this information. MPC may publish the results of any Hunts and pictures of participants in promotional and marketing materials and on social media in accordance with these Terms.

 

7. Third-Party Websites or Resources 

Participants may visit or make use of third-party websites or resources. MPC provides these links only as a convenience and is not responsible for the content, products, or services on or available from those websites or resources, or links displayed on such websites. To the extent permitted under applicable law, you acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites or resources. MPC is not responsible for the availability or quality of third-party services, including cell phone networks, hotspots, wireless internet, and other services. Such third-party services may affect your ability to utilize the Website, and you hereby waive and release MPC and any other party involved in creating or delivering the Website from all claims, demands, causes of action, damages, losses, expenses, or liability which may arise out of, result from, or relate in any way to such third-party services.

 

8. Notice 

Any notices or other communications provided by MPC under the Terms, including those regarding modifications to the Terms, will be given via email and by posting to the Website. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted to any email address you provided.

 

9. Waiver 

MPC’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of MPC. Except as expressly set forth in the Terms, the exercise by either party of any of its remedies under the Terms will be without prejudice to its other remedies under these Terms or otherwise.

 

10. Technology Requirements

 To partake in a Hunt, you must have access to the internet, a computer or mobile device, and any other associated hardware, software, and communication equipment needed to participate, and you are solely responsible for ensuring these are operational and adequately maintained and MPC is not responsible for providing you with any of the aforementioned hardware. MPC does not guarantee that the Website will be compatible with your technology setup. MPC is not responsible for issues arising from technology disruptions or unavailability.

 

11. Privacy Policy 

Your privacy is important to MPC. To better understand our practices, please review our Privacy Policy, which is incorporated by reference into these Terms. 

By entering the contest, you agree that The Mysterious Package Company may collect and use your personal information solely for the purposes of administering the contest, including for prize fulfillment and promotional activities related to the contest. Your information will be processed in accordance with our Privacy Policy

 

12. Intellectual Property

 MPC retains all proprietary rights in the Hunt, Map, Website, and related intellectual property. These rights include but are not limited to copyrights, trademarks, and any other intellectual property rights. You agree not to reproduce, distribute, or display any content without explicit written permission from MPC.

 

13. Termination 

MPC may, at its sole discretion, discontinue your participation in a Hunt or access to the Website without prior notice for any reason, including your breach of these Terms.

15. Limitation of Liability 

By entering the contest, entrants agree to release, discharge, and hold harmless The Mysterious Package Company, its affiliates, subsidiaries, advertising and promotion agencies, and other individuals or organizations involved in the contest, from any liability, claims, losses, and damages arising out of or related to their participation in the contest or the acceptance, use, misuse, or possession of any prize received in this contest.
